Update 07/19/05: It has been revealed to us that the General Conference Corporation of Seventh-day Adventists has begun to move forward with their expected legal persecution of the Creation Seventh Day Adventist Church. A letter has been drafted, but not yet received by our members, which follows the same mode of delivery as was undertaken in the above-mentioned letter to the Davidian, and the previous letters of demand that have been sent to various other Adventist believers over time. With prayer, and by the grace of the Almighty, we will stand in the face of this great evil, and witness for the purity of the Faith of our Savior.

Update 07/22/05: Pastor Walter "Chick" McGill has drafted a letter to the lawfirm being used by the General Conference to enforce the Trademark asking for their understanding in the delay of his receiving the letter, as he is away currently on an evangelistic mission. The Letter may be read here.

Update 10/21/05: Pastor "Chick" has received a certified letter from the General Conference Corporation's attorneys, demanding the surrender of several domain names. This letter appears, upon inspection, to be merely a copy of a previous letter sent to the owner of some domain names maintained by the owner of davidiansda.org, containing only insignificant alterations (see Davidian related communication in the above links). From the letter itself, it appears that the facts of the correspondance have been confused, as they refer to communications with him through the Davidian SDAs (that never took place), and all but one of the domain names they cited are / were owned by the Davidians.. Pastor "Chick" has sent an answer to the letter via certified mail.

Update 03/22/06: The General Conference attorneys have now sent documents to our web-hosting company complaining of certain trademark violations among our domain names. As documentation becomes available we plan to post for your reading.

Update 05/27/06: We have received notice that the General Conference Corporation of SDAs is now threatening our internet domain names on the world scale. Pastor "Chick" has received email notification that the World Intellectual Property Organization (WIPO) Arbitration and Mediation Center has received a complaint against several of our websites, this complaint being dated at May 23rd of this year.

We have also received word that Vincent Ramik (attorney for the General Conference Corporation) has sent a box containing some kind of information to pastor "Chick." As it turns out, pastor "Chick" had recently left on an evangelism trip to Canada, to meet with some of the brethren there who were baptized this last Feast of Unleavened Bread. As such he was not available to receive the package (which we assume is related to the WIPO complaint). When we discover the contents of this package, we will inform our readers.

For now, the CSDA Church covets the prayers of those who have been following our work and ministry. If this matter indeed goes as the Conference would have it go on a world scale, things could move forward very quickly to the end; for when the Trademark is imposed upon the people of Yah on a worldwide stage, it will not be long before the voice of the Witness ceases to be heard on the earth, and then the end will come. Our prayers are with all those who have been sympathizers and supporters, and may Yahshua find our houses in order upon His grand and glorious return.

Update 06/09/06: We have received notice that the official arbitration procedure has begun as of June 8th of this year. We are now in the 20-day response process, and will be making reply to WIPO in a timely fashion, Yahweh willing. The complaint document itself may be viewed HERE. Let us be fervent in prayer as matters continue to develop.

Update 06/16/06: We finally received a seven pound package from the World Intellectual Property Organization (WIPO), in Geneva, Switzerland. It contains the complaint filed by the General Conference, along with all annexes and other official policies set for the arbitration process. This is evidently a duplication of the box that the General Conference attorney tried to have delivered to Pastor "Chick" at the church house in Tennessee.

Update 06/28/06: Our response has been sent to the WIPO doman dispute center by email and by FedEx as of yesterday, 27th of June. The response may be viewed HERE, and the list of annexes sent may be viewed HERE. Our prayers continue upward for Yah's perfect will to be done in this situation.

Update 09/02/06: We have received the decision of the arbitration panel appointed by WIPO. The decision of the panel is that all four of the domain names under dispute must be turned over to the Conference. This will be done automatically at some point in the near future; therefore, we are in the process of updating our current site (csda.us) to house all of our relevant data. We are anticipating that local litigation may follow at any time, therefore we ask for the continued prayers and support of those who protest any and all unions of civil power with ecclesiastical authority. Update 09/27/06: The SDA trademark lawsuit expected for the past 15 years has now begun. The "image of the beast" is imposing "the mark" on the "Remnant Church of Creation 7th Day Adventists." The legal complaint may be viewed by clicking HERE or HERE for printable PDF format.

Update 10/10/06: The General Conference of SDA is now threatening Pastor "Chick" with a demand letter regarding a CSDA domain name in Canada. See images of the letter and Canadian trademark documents following:

Update 12/24/06: The official scheduling order for the McGill lawsuit has been received. A jury trial is set for January 7, 2008 (a three-day trial is expected).

Update 03/25/07: A two-page letter has been sent out to a large number of Adventists to inform them of the Trademark lawsuit, of which most are unaware. Positive responses have already begun to be received as a result of this information.

Update 05/17/07: A Letter of Appeal dated April, 2007, has been drafted to and posted for the benefit of the General Conference Seventh-day Adventist membership.

Update 11/17/07: Judge James Todd rescheduled the three-day jury trial to begin June 2, 2008. Lead attorney for the Plaintiffs, Jeffrey Tew, has officially withdrawn from the trademark lawsuit.

Update 04/29/08: A court order was filed by the judge denying the General Conference motion to prevent a jury trial. This is a signal victory in the McGill case.

Update 05/30/08: Judge Daniel Breen rescheduled the three-day jury trial to begin Monday, October 6th at 9:30 a.m.

Update 06/16/08: An order granting in part and denying in part [pdf/doc] the General Conference's motion for a summary judgment was issued on June 11, 2008. The trademarked name "Seventh day Adventist" was upheld by the judge's decision. A complete victory was denied the Conference, however, regarding the words "SDA and "Adventist." As more information about what this decision means for the CSDA movement becomes available, we will update this page.

Update 07/06/06: During preparation of Pastor Walter McGill's response to the General Conference complaint filed with the WIPO Arbitration Center, he discovered that the conflict between DavidianSDA.org owner and the General Conference was quietly settled.

It can be seen by the following Annexes presented in Pastor McGill's response that in exchange for the domain names 7THDAYADVENTISTCHURCH.ORG, SEVENTHDAYAVENTISTCHURCH.NET, and SEVENTHDAYADVENTISTCHURCH.INFO, the owner of DavidianSDA.org was able to continue ownership and use of 7THDAYADVENTIST.INFO:
Database search for 7THDAYADVENTISTCHURCH.ORG-- Notice that the current owner is Walter Carson of the General Conference of SDA.
Database search for SEVENTHDAYADVENTISTCHURCH.NET-- Notice that the current owner is Stanley Pace, and on page two of the search results it indicates that the date of creation is 05/24/2006.
Database search for SEVENTHDAYADVENTISTCHURCH.INFO-- The creation date is June 20, 2006 and owner is Moniker Privacy Services.
Database search for 7THDAYADVENTIST.INFO-- It is noted here that the owner of this domain name reamains as DavidianSDA.org with the creation date of April 27, 2004.

Obviously, the General Conference of SDA has negotiated a settlement with the owner of DavidianSDA.org. Interestingly, though the General Conference allows DavidianSDA.org to continue use of 7THDAYADVENTIST.INFO, the attorneys representing the General Conference are seeking to have 7TH-DAY-ADVENTIST.ORG transferred from Pastor McGill to the General Conference of SDA.

             Statement re: Restitution Ministries

The Greater Sydney Conference leadership have been working with Restitution Ministries for some time. This finally led to a shared Bible study with leading theologians from the South Pacific Division, including Dr Paul Petersen (Field Secretary) in December 2005. Following this, an opportunity was given to Restitution Ministries to officially declare their ministry as a “Supporting Adventist Ministry” of the Seventh-day Adventist Church. A period of six weeks was given to Restitution Ministries to agree to this status and sign a document which indicated their full support of the 28 Fundamental Beliefs of the Seventh-day Adventist Church.  At the end of this time, Restitution Ministries made it very clear that they do not fully accept the Fundamental Beliefs of the Seventh-day Adventist Church. The particular beliefs that they are not supportive of are the teachings on the Godhead (Fundamental #2), Jesus (Fundamental #4), and the Holy Spirit (Fundamental #5). Therefore, at the February meeting of the Executive Committee of the Greater Sydney Conference, an action was taken to declare Restitution Ministries as an unsupportive independent ministry and therefore not entitled to use the name “Seventh-day Adventist, Seventh-day Adventist Church or SDA Church” in their publications or presentations. This action also indicated that the local churches take appropriate action in harmony with the scriptures and the church manual regarding their membership. We pray that the Holy Spirit may guide us all as we travel toward our Heavenly Home.

HISTORY REPEATS

In 1606, many Pilgrims were driven out of England because they illegally separated from the Church of England. Many were betrayed or lost personal property and dignity. Others were imprisoned, forcibly separated from their families, or driven into exile in Holland.

In the 1630's, the Puritans were persecuted for their efforts to reform and purify the Church of England from within. Unauthorized assemblies for religious worship were prohibited under penalty of imprisonment, exile, torture and death.

Quakers were also persecuted in England because of their refusal to conform to the Church of England. They believed each person could experience God directly, without benefit of church building, clergy or liturgy. Thus, these Quakers were burdened with excessive taxes and charged with blasphemy, disturbing the peace, disorderly behavior, and contempt of court. Many were sentenced to a whipping. Their goods and property were confiscated, and some meeting houses were destroyed. By 1680, 10,000 Quakers had been imprisoned in England, and 243 had died of torture and mistreatment in the King's jails.

In 1685, the Huguenots (Protestants living in Roman Catholic France) were denied their free exercise of religion. Their options were death, imprisonment, or emigration.

The plain, moral lives of the Swiss Brethren, nicknamed Anabaptists, attracted many converts from the state church in Germany. However, around 1700, they were persecuted when they insisted that only believers should be baptized.

October 31, 1731 (on the 214th Anniversary of Martin Luther's Reformation) a Roman Catholic Archbishop in Salzburg, Austria, demanded that all Protestants recant their non-Catholic beliefs or be banished. All Protestant Bibles, books and hymnals were burned. Over 21,475 Protestants were forced into exile. Many fled through snowstorms and icy winds. Their money was soon spent to pay for excessive taxes, tolls, and protection by soldiers from robbers. Despite this adversity, they sang inspirational hymns: "A Mighty Fortress Is Our God" and "Now Thank We All Our God."

By establishing a rich heritage of religious freedom, America became a refuge from religious persecution for thousands of these Pilgrims, Puritans, Quakers, Huguenots, Anabaptists, and Protestants from Salzburg. In 1620, Pilgrims came to America on the Mayflower. In the 1630's, as many as 20,000 Puritans immigrated to New England. Quakers and Anabaptists escaped to Pennsylvania. By 1685 as many as 8,000 Quakers had come to William Penn's haven for religious tolerance. In the hundred years before 1725, about 5,000-7,000 Huguenot religious refugees came to New England, New York, Pennsylvania, Virginia, and South Carolina.

On January 19, 1734, 78 Salzburg exiles sailed for Georgia. Upon their arrival, they named their new home Ebenezer (stone of help or monument to God's protection) according to the sermon they had just heard from I Samuel 7:12.

The First Amendment to the United States Constitution guarantees freedom of religion to all those who live in this country. Yet despite our reputation, rich heritage, and the guarantees of the Constitution, many American Christians are today being denied freedom of religion.

Seventh-day Adventists have long predicted the repeat of history with respect to religious intolerance, even in this "haven of religious liberty" -- the United States of America. With "worldly policy" governing the actions and reactions of "the church" of today, we see on the horizon -- a "civilized inquisition" unfolding. The "overwhelming surprise" comes as this "inquisition" now originates with the Seventh-day Adventist Church itself.

GC to Enter Trademark Case in New York

       The General Conference has authorized its attorneys to file a trademark infringement lawsuit against an independent New York congregation for that body's improper use of the Seventh-day Adventist Church's name.
       The unincorporated body separated from the Immanuel [Emmanuel] Seventh-day Adventist Church in Brooklyn [the Bronx], New York, and goes by the name Emanuel Seventh-day [Seventh Day] Adventist Church. This group has asserted claims against tithes and offerings belonging to the established Adventist Church that is recognized by the Greater New York Conference. The claims were subsequently brought to civil court.
       The GC became involved because of the independent body's continued use of the former church's name, though the group uses a slightly different spelling. GC officials are concerned about the integrity of the Seventh-day Adventist name and wants to prevent confusion with its unauthorized use. The Greater New York Conference made unsuccessful attempts to clear the matter.
